NIL Consent and Authorization Agreement

This NIL Consent and Authorization Agreement covers permission for Varsity Engine to display and use a student-athlete's name, image, likeness, statistics, and submitted media, including on the Platform, in recruiting visibility to verified college programs, and, where separately selected, in promotional material about the athlete or the Platform. For an athlete under 18, this agreement is completed and signed by a parent or legal guardian before the athlete's profile is published, alongside the User Agreement. For an athlete 18 or older, the athlete completes and signs this agreement directly.

This agreement authorizes Varsity Engine to display and use the athlete's name, image, likeness, verified statistics, and submitted media in connection with the Platform, including the athlete's public profile, game recaps and highlight reels, recruiting visibility to verified college programs, and, where separately selected in Section 3, promotional material about the athlete or about Varsity Engine. It does not authorize the sale of a minor's personal information, and it does not by itself authorize any specific photo or video to be uploaded; upload permissions are addressed in the User Agreement and the Copyright and Content Removal Policy.

If the athlete is under 18, this agreement must be completed and signed by a parent or legal guardian before the athlete's profile is published. The signer affirms they are the parent or legal guardian of the athlete, have the legal authority to grant the permissions in this agreement, and are not restricted by any court order or custody arrangement from doing so. If the athlete is 18 or older, the athlete completes and signs this agreement directly. Providing false information about identity or authority may void this consent and result in removal of the athlete's profile.

You select whether the athlete's name, image, likeness, statistics, and submitted media may be displayed on the Platform, in the athlete's recruiting profile visible to verified college programs, and, separately, in promotional material about the athlete or about Varsity Engine. Each of these is a separate, independent choice. Every selection is off by default and takes effect only if you affirmatively check it; each is recorded separately. Basic account access does not require any promotional selection, and declining promotional use does not affect the athlete's ability to hold an account or a recruiting profile. Media is used to build the athlete's verified profile and, where authorized, may appear in game recaps and highlight reels. Authorized uses are licensed to the Company as described in Section 7 of the Terms of Service; the athlete and family retain ownership of media they create.

To confirm authority to consent on behalf of a minor, the Company requires the parent or legal guardian to provide a valid government-issued identification. This document is used solely to verify the guardian's identity and authority, is never displayed on the athlete's public profile, and is handled under the safeguards described in the Privacy Policy. An athlete under 18 cannot activate an account until this agreement has been signed and identity verification is complete.

This license does not permit the sale of a minor's personal information, does not permit the Company to place third-party advertising on or within a minor's profile or media, and does not permit the use of an athlete's name, image, or likeness to endorse a third party's product or service without separate, explicit consent. Varsity Engine will not imply that the athlete endorses Varsity Engine merely because the athlete's profile content appears in a Platform advertisement or promotional material. Unless the Company and the athlete, or the guardian for an athlete under 18, enter into a separate written agreement, no payment, revenue share, or other compensation is owed to the athlete or guardian in connection with the uses authorized here.

A parent or legal guardian, or an athlete 18 or older, may withdraw or narrow this consent in writing at any time by contacting [email protected] or using the tools in the account. On withdrawal, the affected use stops and the profile is removed from recruiting or promotional visibility as applicable, subject to a reasonable processing period and to records the Company is required to keep by law. Withdrawal is not retroactive: it does not undo uses that already occurred while this consent was active, and copies may remain in backups or where retention is legally required. Consent granted by a guardian automatically ends when the athlete turns 18 and assumes control of their own authorization.

A copy of this signed agreement, the selections made, and the verification record described in Section 4 is retained for compliance purposes and is available to the guardian or athlete on request. This agreement remains in effect until withdrawn, narrowed, or superseded, or until the athlete turns 18, whichever occurs first.

This agreement works together with the User Agreement, which governs the athlete's account, conduct, and participation on the Platform, the Terms of Service, which sets out the full legal scope, duration, and limits of the license granted here, and the Copyright and Content Removal Policy, which governs how a third party can object to media, including media of another minor who appears incidentally in game footage. The selections you sign in this agreement control the scope of the authorized NIL uses. The Terms of Service govern only the operational mechanics of that license and do not expand it; if the Terms of Service could be read to authorize a use these signed selections did not permit, these signed selections control.

Typing your full legal name and submitting this agreement constitutes a legally binding electronic signature. Signer full legal name.
